ITEM: AUTHORIZATION TO CONTINUE WITH THE DEVELOPMENT OF THE 40TH STREET PROJECT USING THE ALIGNMENT PROPOSED BY THE DEVELOPER
REQUEST: Authorization to continue with the development of the 40TH Street Project using the alignment proposed by the Developer.

EXPLANATION: In December, 2008, the Wellington Council approved a Master Plan Amendment (R2008-75) for the Grand Prix Acres (renamed to Grand Prix Village South) subdivision. The approval was subject to several conditions, including the requirement to construct an east-west connector roadway between Grand Prix Village South and South Shore Boulevard and to make provisions for bridle trail connectivity. A copy of the 2008 Master Plan Amendment is attached as Exhibit 1.
On April 8, 2013, the Developer (Far Niente VI) acknowledged and accepted a Letter of Understanding (LOU) outlining the steps to move forward with the roadway project potentially using the 40th Street alignment. A copy of the LOU is attached as Exhibit 2. In May/June, 2013, the Developer submitted conceptual design plans indicating the 40th Street alignment potentially could work. The Village Engineer approved the proposed 40th project alignment, provided it met all engineering standards and the intent of the Master Plan Amendment, including bridle trail connectivity. A map showing the proposed alignment is attached as Exhibit 3. Though not 100% complete and not yet approved, the latest set of engineering plans (dated May 7, 2014), largely meet Wellington's engineering standards and the intent of the master Plan Amendment. Major outstanding issues include: 1) submission of plans for the Lake Worth Road signal; 2) confirmation that FPL will relocate electrical power poles along the south side of the proposed roadway; and 3) providing details on bridle trail links and phasing. The Developer's engineering consultant is working to resolve these issues.
To date, the Engineering Department has registered concerns from three (3) property owners along the proposed alignment. Two of the property owners are concerned about bridle trail connectivity to the west and want to make sure connectivity is maintained. One property owner (Tonkawa/Glenspur) wants the roadway, adjacent to his property, to be constructed on the north side of the C-24 canal (instead of the south side of the C-24 canal and immediately next to his property). To this end, the property owner has submitted a conceptual design for the roadway on the north side of the canal. It is attached as Exhibit 4.
From an engineering perspective, either alignment would be acceptable as long as it meets Wellington's engineering standards and the intent of the Master Plan Amendment. In fact, this type of flexibility is built into the Master Plan Amendment (Condition #2). At this point, the alignment proposed by the Developer complies with requirements.
