ITEM: AUTHORIZATION TO AWARD A CONTRACT FOR THE CONSTRUCTION OF THE C-23 MULTIUSE PATH AND BRIDLE TRAIL
REQUEST: Authorization to award a contract for the construction of the C-23 Multiuse Path and Bridle Trail Project (Option 2) to Rosso Site Development, Inc. in an amount not to exceed $575,000.

EXPLANATION: This proposed award of contract was presented to Council on May 25, 2014. At the May 25th Council meeting, the Council decided not to award the contract and directed staff to present the project to the Equestrian Preserve Committee. Staff presented the project to the Equestrian Preserve Committee at its regularly scheduled meeting on July 9, 2014, which included four (4) options for crossing Palm Beach Point Boulevard. Three (3) of the options were the same options presented to Council on May 25th. A fourth option was developed and presented to the EPC for consideration. All options are described below. The EPC voted unanimously for Option #2. Generally, the EPC believed Option #2 offered the most direct and safest route for equestrians.
Option #1 provides access across Palm Beach Point Blvd for the Multiuse and Bridle paths approximately 32 ft. north of the south right-of-way line of the C-23 canal and approximately 55 ft. north of the gatehouse. The Palm Beach HOA is opposed to this option.
Option #2 provides access across Palm Beach Point Blvd for the Multiuse and Bridle paths along the north right-of-way line of the C-23 canal right of way approximately 120 ft. north of the gatehouse. The Palm Beach HOA is opposed to this option. This is the option recommended by staff.
Option #3 provides access across Palm Beach Point Blvd for the Multiuse and Bridle paths approximately 520 ft. north of the gatehouse. This option will require full roadway realignment and reconstruction of Palm Beach Point Blvd. This is the option preferred by the Palm Beach Point HOA.
Option #4 provides access across Palm Beach Point Blvd for the Multiuse and Bridle paths approximately 300 ft. north of the gatehouse. This option does not require relocation of the roadway realignment and reconstruction of Palm Beach Point Blvd. It does, however, require equestrians, pedestrians and bicyclists to share a 230 foot segment of paved, 9 foot wide multiuse path along the western side of Palm Beach Point Boulevard. This option could be favorably considered by the Palm Beach Point HOA.
On April 7, 2014, Wellington released ITB #013-14/DZ on DemandStar. The solicitation was also advertised in the Palm Beach Post and posted on Wellington's website. On April 16, 2014, a mandatory pre-bid meeting was held and nine (9) potential bidders attended. On May 6, 2014, five (5) proposals were received. A summary of the bids is provided below. The bids include an owner controlled 10% contingency and an owner controlled allowance for permitting.

The lowest, responsive, responsible bidder for each of the three options is Rosso Site Development, Inc. of Lake Worth, Florida. Rosso also is a local Palm Beach County vendor. Although Rio-Bak Corporation is a local Western Communities vendor, its bid was not within 5% of the low bid and therefore was not eligible to provide a matching price. No protests have been filed. The bids are valid for 120 days following the issuance of the Intent to Award the Contract. The Intent Letter was issued on May 12, 2014. The expiration date of the bid is September 11, 2014.
From an engineering perspective, Option #2 provides the best approach. Further, the cost for Option #2 ($583,422.15), including a 10% ($57,500) owner controlled contingency, is just slightly above the approved project budget of $575,000. If either Option #1 or Option #2 is selected, it is recommended that the contingency amount be reduced so that the total contract amount is $575,000. If Council elects to approve Option #3, a budget reallocation will be required in the amount of $147,881.
Option #4 also is a possibility. The projected cost, based upon the unit pricing provided by Rosso, is $654,959. Though not specifically bid, the framework of the contract allows for the change. Specifically, this contract is a unit price contract whereby Wellington pays only for the quantities/items actually constructed. If this Option is selected, the contract quantities would be amended and a budget reallocation would be required in the amount of $79,959.
Staff is recommending awarding the contract to Rosso Site Development, Inc., with Option #2 preferred by staff and recommended by the EPC.

FISCAL IMPACT: The approved budget for the project is $575,000 - $275,000 for the pathways and $300,000 for the culvert replacement. Funding for the pathways is available in the Equestrian Trails Capital Project budget and funding for the culvert replacement is available in the Surface Water Management System Rehabilitation budget.
