ITEM: RESOLUTION NO. R2015-02 (INTERLOCAL AGREEMENT WITH PALM BEACH COUNTY TO PROVIDE ACCESS TO THE COUNTY'S CONSTRUCTION CONTRACTOR ENROLLMENT PROGRAM DATABASE)
A RESOLUTION OF WELLINGTON, FLORIDA'S COUNCIL APPROVING AND AUTHORIZING THE MAYOR AND CLERK TO EXECUTE AN INTERLOCAL AGREEMENT WITH PALM BEACH COUNTY TO UTILIZE THE COUNTY'S CONSTRUCTION CONTRACTOR INFORMATION AS PART OF THE CONTRACTOR ENROLLMENT PROGRAM; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.
REQUEST: Approval of Resolution No. R2015-02 for the Interlocal Agreement with Palm Beach County to provide access to the County's Construction Contractor Enrollment Program database.

EXPLANATION: The Interlocal Agreement with Palm Beach County was previously approved and rescinded due to a conflict with Chapter 70-857, Laws of Florida (1970), regarding fee sharing for business tax receipts. The proposed agreement addresses the conflict and will eliminate the need for State and Palm Beach County licensed contractors to register in Wellington prior to obtaining a building permit.
Currently, construction contractors wishing to do business in Palm Beach County must not only enroll in the County but also in each municipality. The interlocal agreement establishes an enrollment program for contractors which will allow them to do business with all jurisdictions participating in the program after registering with the County. Participating municipalities can choose various methods for accessing contractor information including via the County's website or by implementation of an automated process. Palm Beach County will also send email notices to participating municipalities of a contractor's unanticipated change in status.
Entering into this agreement will reduce contractor wait time by eliminating the need for registration which currently includes verification of the contractor licensure, General Liability and Workers Compensation Insurance.
