REQUEST:                     Approval of Resolution No. AC2026-02 approving a land swap agreement with MH Wellington 2023 LLC and authorizing the Acme Board President and Board Secretary to execute all deeds and other documents necessary to close on the exchange of property.

EXPLANATION:                     MH Wellington 2023 LLC (“MH”) is the owner of a number of parcels within the Mallet Hill subdivision.  MH is seeking to square off its property line by acquiring a portion of the corner of Pierson Road and Southshore Blvd. in exchange for conveying a needed bridle path to Acme.  The bridle path is adjacent to Pierson Road, as depicted in the Location Map attached as Exhibit B to the Land Swap Agreement.  As additional consideration, MH has also agreed to pay Acme the sum of $200,000.  Closing is contingent upon MH’s completion of a number of tasks, including approval of a partial replat to reconfigure the impacted Mallet Hill lots and subdivide the existing MH parcel to create the bridle path, obtaining parcel valuations from the Property Appraiser, obtaining a release of the bridle path from the current Declaration of Restrictive Covenants governing Mallet Hill, obtaining a setback variance through the public hearing process, and modifying the existing unity of control over the lots owned by MH.
