EXPLANATION: House Bill (HB) 399, Land Use and Development Regulations (Chapter 2026-7), was approved by the Florida Legislature during the 2026 Legislative Session and signed into law by the Governor. HB 399 modifies how local governments evaluate the compatibility of allowable residential land uses within residential zoning districts and within the residential future land use category by limiting the reliance on subjective compatibility determinations. The Bill requires local governments to establish objective standards to assess the compatibility of residential uses and to provide measures to mitigate or minimize potential incompatibility. Both the Comprehensive Plan and Land Development Regulations require updates to include factors for assessing compatibility of allowable uses.
Wellington is seeking to amend the Land Use & Community Design Element of Wellington’s Comprehensive Plan by adding policies relating to compatibility, factors, and mitigation measures for residential land uses. The proposed amendment includes the following:
• Policy LU&CD 1.1.3 - provides factors in determining residential compatibility when adjacent to other residential.
• Policy LU&CD 1.1.4 - requires the LDR to be amended to include factors for assessing compatibility.
• Policy LU&CD 1.1.5 - requires the LDR to be amended to include mitigation measures for reducing incompatibility.
At the October 21, 2026 Planning, Zoning and Adjustment Board meeting, the Board unanimously (7-0) recommended approval of Ordinance No. 2026-20.
