A RESOLUTION OF THE BOARD OF SUPERVISORS OF THE ACME IMPROVEMENT DISTRICT ACCEPTING THE CONVEYANCE OF 5.19 ACRES (EXHIBIT A) SITUATED IN SECTION 21, TOWNSHIP 44 SOUTH, RANGE 41 EAST AND TO ACCEPT THE GRANT OF 1.12 ACRES SITUATED IN SECTION 21, TOWNSHIP 44 SOUTH, RANGE 41 EAST AS A NON-EXCLUSIVE PERPETUAL INGRESS, EGRESS, ACCESS EASEMENT, BRIDLE PATH EASEMENT AND CANAL MAINTENANCE EASEMENT ON, IN, OVER AND ACROSS THE EASEMENT AREAS LEGALLY DESCRIBED AND SHOWN ON EXHIBIT B FOR HORSES, PEDESTRIAN FOOT TRAFFIC, AND CANAL MAINTENANCE; AND PROVIDING AN EFFECTIVE DATE.

EXPLANATION:                     This is a petition for the replat of 40.14 acres lying in Section 21, Township 44 South, Range 41 East, Village of Wellington, Palm Beach County, Florida.  The project site is located between the Acme C4 Canal and the Civic Site of Wellington Countryplace.  A location map is provided as Attachment 1.  The owner is Far Niente Stables VII, LLC.  This is a replat for the expressed purpose to divide the parcel into two (2) tracts.  Tract 1 is reserved for Far Niente Stables VII, LLC for future development and Tract 2 is dedicated to Acme for access and maintenance of storm water canals.  The plat also provides the necessary ingress, egress, storm water management and utility easements for the subdivision.

The Improvement Agreement between Far Niente Stables VII, LLC (“Owner”), Wellington Lifestyle Partners, LLC (collectively referred to as the “Developer”) and ACME Improvement District (“ACME”) is for the purpose of designing, permitting, and constructing certain improvements to real property (“Property”).  

 

The Developer is seeking permits and approvals from the applicable governmental authorities to permit, construct, and manage a master plan development on property owned by Owner.  As consideration for the Approvals, Owner has agreed to convey the Property by Warranty Deed to Acme Improvement District.

 

The Developer will be responsible for the design, permitting and construction of certain canal improvements to a portion of the canal owned and operated by Acme as well as the design, permitting and construction of a bridle path within the Property and Bridle Path Easement Area.

 

The Village desires to grant to Developer the rights to design, permit and construct certain improvements as specified in the Improvement Agreement, as well as to manage and maintain the Bridle Path Easement Area within the Property.

 

The Warranty Deed from Far Niente Stables VII, LLC (“Grantor) to Acme Improvement District (“Grantee”) conveys to Grantee the 5.19 acre Property (see Exhibit A to Warranty Deed) and reserves to the Grantor, a non-exclusive perpetual ingress, egress, access easement, Bridle Path Easement and Canal Maintenance Easement for horses, pedestrian foot traffic, and canal maintenance.

 

Staff recognizes that the citizens of Wellington would be best served by accepting this conveyance to assist in the operations and maintenance of the ACME Improvement District stormwater management system.
