ITEM: AUTHORIZATION TO AWARD A CONTRACT FOR THE WELLINGTON ENVIRONMENTAL PRESERVE GREENWAY PROJECT
REQUEST: Authorization to award a contract to Dickerson Florida, Inc. for the Wellington Environmental Preserve Greenway Project in the amount of $793,851.17.

EXPLANATION: The Wellington Environmental Greenway Project provides a new 8 ft. to 10 ft. wide paved multi-use path paralleling Flying Cow Road from the Wellington Environmental Preserve to approximately 900 feet south of Southern Boulevard. The path will connect to the new C-23 multi-use path near the south end (just north of the Wellington Environmental Preserve) and a new Binks Forest multi-use path near the north end, creating connectivity to the multi-use path system in Wellington. Shade structures and landscaping will be provided along the path. A condensed version of the project plans is provided as Exhibit A.
This project primarily is funded by a Local Agency Program (LAP) Grant administered by the Florida Department of Transportation (FDOT). Wellington's Council approved the formal agreement with FDOT for this project on February 10, 2015. Pursuant to the agreement, Wellington must adhere to the requirements of FDOT, including stringent reporting requirements (payroll - Davis Bacon Act, disadvantaged business participation) and construction standards. In an effort to ensure compliance with these provisions and receipt of grant proceeds, staff required contractors to be FDOT certified and to have a minimum of five (5) years' experience with similar projects.
On March 23, 2015, Wellington released ITB #001-15/DZ on Demandstar. The solicitation was also advertised in the Palm Beach Post and posted on Wellington's website. On April 29, 2015, three (3) proposals were received.

Rosso Site Development submitted the lowest bid, but did not meet the minimum qualifications specified in the bid documents summarized below:
· The firm was not FDOT pre-qualified at the time bids were due.
· The firm did not have five consecutive years' experience.
For this reason, Rosso was deemed non-responsive. Therefore, staff is recommending award of contract to Dickerson Florida, Inc. the lowest, responsive, responsible bidder, in the amount of $793,851.17, including a $36,000 contingency. The Florida Department of Transportation (FDOT) grant will cover $721,280.00 of the project amount. The Village will be responsible for $72,571.17.
Pursuant to the provisions of the FDOT LAP Agreement, the Village's local preference policy cannot be used - it is expressly prohibited by the agreement.
