A RESOLUTION OF WELLINGTON, FLORIDA'S COUNCIL, APPROVING A MASTER PLAN AMENDMENT (PETITION NUMBER 2013-61 MPA 2) FOR CERTAIN PROPERTY KNOWN AS POD "L" (BINKS POINTE F.K.A. RESIDENCES AT BINKS FOREST GOLF CLUB) OF THE LANDINGS AT WELLINGTON PUD, TOTALING 15.27 ACRES, MORE OR LESS, LOCATED APPROXIMATELY 1/2 MILE SOUTH OF SOUTHERN BOULEVARD ON THE WEST SIDE OF BINKS FOREST DRIVE, AS MORE SPECIFICALLY DESCRIBED HEREIN; TO INCREASE THE ACREAGE OF POD "L" BY INCLUDING PARCEL "V" 0.26 ACRE, DESIGNATE POD "L" AS OPTIONAL RESIDENTIAL (OR) AND AMEND CONDITIONS OF APPROVAL; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.

EXPLANATION: This Master Plan Amendment amends The Landings at Wellington PUD Master Plan increasing the acreage of POD "L" by including the former Parcel "V" 0.26-acre preserve area, designating Pod "L" as Optional Residential (OR), and amending certain conditions of approval.
The Landings at Wellington PUD Master Plan POD "L" (15.27 acres - Bink's Pointe) is increasing its acreage by including the 0.26-acre preserve area labeled Parcel "V." Bink's Pointe (F.K.A. Residences at Bink's Forest Golf Club) project was approved for 90 multi-family townhouse dwelling units. The increase in acreage of the Bink's Point project by 0.26 acres does not include any additional units. The increase allows the reconfiguration of the lots to accommodate a proposed two-story, 90-unit townhouse layout and avoids direct orientation to the 240 feet wide Florida Power & Light easement along the north property line.
The proposed individual lot configuration for each townhouse does not comply with the minimum setback requirements due to the proposed change from three- story to two-story buildings. The petitioner is requesting an Optional Residential (OR) overlay designation for Pod "L" for a reduction from setback requirements (Sec. 6.8.2.F.1.vii. (d), Land Development Regulations). The proposed setbacks are 22.5 ft. front, 12 ft. side interior, 18 ft. side street and 16 ft. rear.
The Optional Residential (OR) designation is "intended for residential pods that encourage innovative development by providing recreation, privacy, property maintenance, parking, site amenities and enhanced circulation." The petitioner's justification for the OR designation is attached as Exhibit "F" of the staff report. A multi-use pathway along the north property line to continue the pathway system in this section of Wellington is recommended for the OR designation. This multi-use pathway will enhance circulation by providing a connection between Binks Forest Drive and Flying Cow Road for bicyclists, pedestrians, and equestrians. The proposed multi-use pathway is a major element of the justification for the OR designation. The petitioner has agreed to dedicate the area of the pathway to Wellington. Also the petitioner will either construct the pathway or pay for the pathway construction. Discussion with the two adjacent property owners to provide the connection from this project's west property line to Flying Cow Road has been ongoing. This MPA request also extends the build out date to December 31, 2018 and updates other existing conditions.
At the August 6, 2014 Planning, Zoning and Adjustment Board (PZAB) meeting, the Board recommended approval (6 - 0) of Resolution No. 2014-27, a Master Plan Amendment to amend The Landings at Wellington PUD Master Plan to increase the acreage of POD "L" by including the former Parcel "V" 0.26 acre preserve area, designate Pod "L" as Optional Residential (OR), and amend conditions of approval.
