ITEM: RESOLUTION NO. R2025-48 (DESIGNATING THE VILLAGE ENGINEERING DEPARTMENT TO ADMINISTRATIVELY APPROVE PLATS AND REPLATS)
A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL , PURSUANT TO CHAPTER 2025-164, LAWS OF FLORIDA, DESIGNATING THE VILLAGE ENGINEERING DEPARTMENT AS THE ADMINISTRATIVE AUTHORITY TO RECEIVE, REVIEW, PROCESS, AND ADMINISTRATIVELY APPROVE PLAT AND REPLAT APPLICATIONS THAT COMPLY WITH SECTION 177.091, FLORIDA STATUTES, WITHOUT FURTHER ACTION BY THE VILLAGE COUNCIL; AND PROVIDING AN EFFECTIVE DATE.
REQUEST: Approval of Resolution No. R2025-48 designating the Village Engineering Department as the administrative authority to receive, review, process, and administratively approve plat and replat applications that comply with Section 177.091, Florida Statutes, without further action by the Village Council.

EXPLANATION: The Florida Legislature has enacted Chapter 2025-164, Laws of Florida, effective July 1, 2025, which amends Section 177.071, Florida Statutes.
Pursuant to the new law, a plat or replat submitted under Part I, Chapter 177, Florida Statutes, must be administratively approved without further action by the governing body of a municipality.
Section 177.071, Florida Statutes, requires the governing body of a municipality to designate an administrative authority to receive, review, and process plat or replat submittals.
The Village of Wellington seeks to ensure timely and efficient processing of plats and replats in accordance with state law. The acceptance of such plats or replats may grant Wellington or its dependent special district, Acme Improvement District (“Acme”), certain interests in the property described in the plat or replat.
With the approval of this Resolution, the Wellington Council hereby designates the Wellington Engineering Department as the administrative authority to receive, review, process, and administratively approve plat and replat applications that comply with Section 177.091, Florida Statutes, without further action by the Village Council, and further authorizes both the Village Engineer and the Village Utilities Director to accept all dedications to Wellington and Acme on such plats and replats by affixing their signatures to the documents prior to recording in the public records of Palm Beach County.
