EXPLANATION:  Code Compliance initiated an action concerning property maintenance issues located at 12159 Cuddington Court, in the Wellington Downs community. The property was cited as part of a neighborhood wide inspection.  The Wellington Downs Homeowners Association took ownership of the property via foreclosure in October 2012 and was issued a courtesy notice for stains and deterioration of the roof, stained driveway/walkway and a window mounted air conditioner. The property is currently involved in a foreclosure action with Bank of America.  
 
The Management Company contacted the Code Officer and explained that after their foreclosure action, the HOA lacked funds to make the needed repairs and cleaning of the roof, driveway and walkway.  Extensions were granted by staff to permit the lender foreclosure action to complete.  A later review of the foreclosure action found the case was stalled due to the death of an owner and the most recent action involved the Court appointment of a Guardian Ad Litem.  The case may take several years to conclude. Subsequently, at the request of Code Compliance Staff, the HOA corrected the driveway, walkway and window air conditioner issues.  The case is scheduled for presentation to the January 15, 2015 Special Magistrate for the remaining roof issue. The HOA has indicated they do not have the funds to make the roof repairs. Direction is requested regarding the code compliance action relative to the recent court appointment and foreclosure finalization.
