A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL AUTHORIZING THE MAYOR AND VILLAGE CLERK TO EXECUTE AMENDMENT NUMBER ONE (1) TO LANDSCAPE MAINTENANCE MEMORANDUM OF AGREEMENT BETWEEN THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION AND THE VILLAGE OF WELLINGTON FOR MEDIAN LANDSCAPING IN THE MEDIAN OF STATE ROAD 7 (US 441) BETWEEN FOREST HILL BOULEVARD AND MEDICAL PARK BOULEVARD; AND PROVIDING AN EFFECTIVE DATE.

A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL AUTHORIZING THE MAYOR AND VILLAGE CLERK TO EXECUTE AN AGREEMENT WITH WELLINGTON REGIONAL MEDICAL CENTER LLC RELATING TO INSTALL LANDSCAPING IN THE MEDIAN OF STATE ROAD 7 (US 441) BETWEEN FOREST HILL BOULEVARD AND MEDICAL PARK BOULEVARD; AND PROVIDING AN EFFECTIVE DATE.
REQUEST: Approval of Resolution No. R2023-12 accepting and authorizing the execution of Amendment No. 1 to State of Florida District Four (4) Department of Transportation Landscape Maintenance Memorandum of Agreement for the additional landscape improvements on State Road 7 (US 441) between Forest Hill Boulevard to Medical Park Boulevard and Approval of Resolution No. R2023-48 accepting and authorizing the execution of a Landscape Installation and Maintenance Agreement with Wellington Regional Medical Center LLC (Exhibit A - Location Map).

EXPLANATION: On March 20, 2007, Village Council approved with Resolution No. R2007-47 the Joint Participation Agreement and the Maintenance Memorandum of Agreement between the Village of Wellington and State of Florida Department of Transportation (Exhibit B - Resolution No. R2007-47).
In February 2023, Wellington Regional Medical Center LLC (WRMC) expressed their wish to install landscaping in the median of State Road 7 (US 441) between Forest Hill Boulevard and Medical Park Boulevard. This portion of State Road 7 (US 441) is under the jurisdiction of the State of Florida, Department of Transportation (FDOT). The FDOT will approve the installation of landscaping only if a government agency, rather than a private entity, agrees to provide maintenance of the project upon completion. Therefore, WRMC has requested that the Village of Wellington (VOW) enter into the Landscape Maintenance Memorandum of Agreement with FDOT, and also enter into a separate agreement with WRMC wherein the installation and maintenance obligations of the VOW will be performed by WRMC.
On April 25, 2023, FDOT forwarded to the Village of Wellington Amendment No. 1 to Landscape Maintenance Memorandum of Agreement (Exhibit C - FDOT Amendment No. 1 to LMMOA).
On August 21, 2023, the Village of Wellington received from WRMC an executed Landscape Installation and Maintenance Agreement (Exhibit D - WRMC Landscape Maintenance Agreement).
Over the years, the Village of Wellington has entered into similar agreements with various entities for landscape improvements on State Road 7 (US 441) from Forest Hill Boulevard south to Lake Worth Road and north to one mile before State Road 80.
