ITEM: DISCUSSION OF POLICY FOR EXEMPTION OF FEES FOR WELLINGTON DEVELOPMENT PROJECTS AND CONSTRUCTION ACTIVITY
REQUEST: Authorize the Village Manager to amend contracts for applicable Wellington projects to be consistent with the policy exempting Wellington projects and construction activity from Wellington fees.

EXPLANATION: The Village staff performs all work associated with permits, licenses, and applications for Village operating and capital construction projects by utilizing staff and related resources. The Village also addresses all development impacts from Wellington facilities as required, using Village budgeted funds. The policy for the fee exemption for these activities acknowledges that the fees represent a "double" payment for the services and projects associated with the permits, licenses, applications, and development activities.
The policy, whose effective date is July 15, 2025, is attached as Exhibit 1. In addition to the policy, a staff memorandum dated June 30, 2025 and attached as Exhibit 2, directs all permit fee charges totaling $50,000 or more between October 1, 2023, and July 30, 2025, to be returned to the appropriate general ledger account. The transfer includes all qualifying permit fees collected within the specified timeframe and is intended to ensure Village capital projects are not charged for these fees.
The two Village projects that exceed $50k in total permit fees are the Wellington Athletics Facility (CEN23016) and the Wellington Aquatics Facility (CPW22009). To be consistent with the policy, the contracts for the project may need to be amended. Staff requests authorization for the Village Manager to revise the project contract terms to be consistent with the policy.
