ITEM: ORDINANCE NO. 2024-14 (AUTHORIZING THE PLACEMENT, INSTALLATION AND OPERATION OF A SPEED DETECTION SYSTEM WITHIN WELLINGTON SCHOOL ZONES AND PROVIDING FOR TRAFFIC ENFORCEMENT PROCEDURES)
AN ORDINANCE OF WELLINGTON, FLORIDA'S COUNCIL CREATING ARTICLE VI OF CHAPTER 22 OF THE VILLAGE'S CODE OF ORDINANCES TO AUTHORIZE THE PLACEMENT, INSTALLATION, AND OPERATION OF SPEED DETECTION SYSTEMS ON ROADWAYS MAINTAINED AS SCHOOL ZONES, ESTABLISHING TRAFFIC ENFORCEMENT PROCEDURES WHEN SPEED DETECTION SYSTEMS ARE UTILIZED FOR SCHOOL ZONE SPEED LIMIT VIOLATIONS, AND CREATINGE HEARING PROCEDURES RELATING TO SUCH SCHOOL ZONE SPEED LIMIT VIOLATIONS; PROVIDING FOR IMPLEMENTATION; PROVIDING FOR CODIFICATION; PROVIDING A CONFLICTS CLAUSE; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.
REQUEST: Approval of Ordinance No. 2024-14 establishing Article VI of Chapter 22 of the Village's Code of Ordinances to authorize the placement, installation and operation of a speed detection system within Wellington school zones and providing for traffic enforcement procedures.

EXPLANATION: In July, 2023, the Florida Legislature passed House Bill 657, codified as Chapter 2023-174, Laws of Florida, to permit the use of speed detection systems to enforce school zone speeding violations in excess of 10 miles per hour over the posted speed limit. Prior to utilizing such a system, Wellington is required to adopt an ordinance authorizing the placement and installation of such systems and to create traffic enforcement procedures. The bill also requires Wellington to conduct a study to determine whether each school zone presents a heightened safety risk that would warrant additional traffic enforcement measures based upon traffic data collected and set forth in a report.
