ITEM: NOTICE OF SPECIAL MAGISTRATE'S INTENT TO CONTINUE TO SERVE AND CONSIDERATION TO REAPPOINT, AND DIRECTION REGARDING PENDING VACANCY
REQUEST: 1) Notice of Special Magistrate Hollie Hawn's intent to continue to serve and consideration to reappoint, and 2) Direction regarding pending vacancy from Magistrate Posner's intent to not seek reappointment.

EXPLANATION: Ordinance No. 2022-05, which adopted Wellington's Code of Ordinances, provides that one or more special magistrates shall be appointed by the Council to service two-year terms and may be reappointed for an additional two-year term every two years thereafter unless the magistrate no longer wishes to serve or is removed by Wellington's Council.
Approximately 120 days prior to the expiration of a magistrate's term, staff shall contact the magistrate to ascertain if the magistrate wishes to continue to serve. If the special magistrate wishes to continue to serve, staff will notify Council of the magistrate's response and Council will then decide whether to continue with or remove the special magistrate. If a special magistrate responds that they will not continue to serve, or is removed by the Village Council, staff shall advertise a Request for Letters of Interest (LOI) for the position. A selection committee shall be formed to review the candidate submissions and to rank the applications as outlined in Wellington Code of Ordinances and the Purchasing Manual.
Wellington presently has three (3) Special Magistrates to hear and decide Code Compliance cases. 1) Michael Posner, 2) Hollie Hawn, and 3) Nabors, Giblin & Nickerson, PA which includes Valerie Vicente and/or Bradley H Weissman with Alain E. Boileau if needed. Michael Posner's and Hollie Hawn's terms will be expiring in 2026 and require notice of intent to continue to serve, while Nabors, Giblin & Nickerson, PA is effective through April 3, 2027.
