ITEM:  RECONSIDERATION OF CONDITION 32 OF THE MOTION APPROVING THE EQUESTRIAN VILLAGE COMPATIBILITY DETERMINATION FOR A COMMERCIAL EQUESTRIAN ARENA APPLICATION
 
REQUEST:  To reconsider condition number 32, previously condition number 30 of Resolution No. R2013-49 that was recommended by Council on October 24, 2013 for the Compatibility Determination for a Commercial Equestrian Arena at Equestrian Village.

EXPLANATION:  Councilman Willhite's motion approving the Compatibility Determination for a Commercial Equestrian Arena for Equestrian Village had a condition (previously number 30) that the site plan be approved by DRC and be in substantial compliance with the conceptual site plan that is an exhibit to Resolution No. R2013-49.  Councilman Willhite requested that the final site plan be brought back to Council for approval. Staff had suggested that the condition (now number 32) be modified further to remove the language regarding substantial compliance with the conceptual site plan as it was not necessary since the conceptual site plan was mentioned elsewhere in the Resolution.  The motion was opened for reconsideration to clarify the intent of the condition. Staff believes that the intent of Councilman Willhite's motion was to bring the final site plan back to Council for approval and that it will be in substantial compliance with the Conceptual Site Plan. This matter is being brought back to Council for reconsideration and clarification.
