ITEM: RESOLUTION NO. R2017-22 (AMENDMENT TO THE INTERLOCAL AGREEMENT WITH THE PINE TREE WATER CONTROL DISTRICT)
A RESOLUTION OF WELLINGTON, FLORIDA'S COUNCIL AUTHORIZING THE MAYOR TO EXECUTE AN AMENDMENT TO THE INTERLOCAL AGREEMENT DATED MAY 25, 2004 BETWEEN THE VILLAGE OF WELLINGTON AND PINE TREE WATER CONTROL DISTRICT (PALM BEACH COUNTY) AND PROVIDING FOR AN EFFECTIVE DATE.
REQUEST: Approval of Resolution No. R2017-22 approving the Amendment to the Interlocal Agreement dated May 25, 2004 between the Village of Wellington and Pine Tree Water Control District (Palm Beach County).

EXPLANATION: The Village of Wellington and Pine Tree Water Control District (Palm Beach County) entered into an Interlocal Agreement (ILA) on May 25, 2004. In the ILA, Wellington agreed to provide certain general governmental services to the District, including, among other things, maintenance of certain roadways with the lands comprising the District. The ILA also contemplated that Pine Tree would become a dependent district of the Village; however, the electors of the District voted on July 18, 2006 against that.
On October 26, 2016, in accordance with Section 19 of the ILA, Wellington provided a Notice of Termination of the agreement to the District. The effective date of the termination of the agreement is July 23, 2017. Since the parties believe it to be in their mutual interest for Wellington to continue to maintain the roadways within the District through September 30, 2017 to coincide with the fiscal year period for gas tax collection, the parties have agreed to amend the Interlocal Agreement, a copy of which is attached which outlines the terms of the amendment.
