A RESOLUTION OF WELLINGTON, FLORIDA'S COUNCIL, VACATING A 223 SQUARE FEET PORTION OF THE 12 FOOT WIDE WATER AND SEWER EASEMENT LOCATED AT THE SOUTH BOUNDARY OF LOT 1 OF ANTHONY GROVES PLAZA REPLAT (165 SOUTH STATE ROAD 7); AND PROVIDING AN EFFECTIVE DATE.
REQUEST: Approval of Resolution No. R2015-72 to vacate/abandon a 223 square feet portion of the 12 foot wide Water and Sewer Easement located at the south boundary of Lot 1 of Anthony Groves Plaza Replat (165 South State Road 7).

EXPLANATION: Martin Heise, Manager of Legacy Shoppes, LLC, is requesting to vacate/abandon a portion of the 12 foot wide Water and Sewer Easement, approximately 223 square feet, located at the south portion of Lot 1 of Anthony Groves Plaza Replat as recorded in Plat Book 110 on Page 65 of the Public Records of Palm Beach County, Florida. The owner is seeking the vacation/abandonment to construct a retail shopping plaza totaling 18,000 square feet and parking lot which will encroach into the unused water and sewer easement dedicated to the Village of Wellington. The property is located within the Village of Royal Palm Beach; however, the Village of Wellington provides water and sewer service to the property.
The Engineering Services Department has determined this request to vacate/abandon a portion of the 12 foot wide Water and Sewer Easement to be consistent with the public interest and will not adversely affect water or sewer service to other properties. The Vacation/Abandonment application (HTE 14-20004 / 2014-043 VAC) is provided for review.
