ITEM: ORDINANCE NO. 2025-10 (CODE OF ORDINANCES AMENDMENT TO CHAPTER 13-OFFENSES AND MISCELLANEOUS PROVISIONS, ARTICLE II - NOISE STANDARDS)
AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING CHAPTER 13 (“OFFENSES AND MISCELLANEOUS PROVISIONS”), ARTICLE II (“NOISE STANDARDS”), SECTION 13-7 (“SPECIFIC PROHIBITIONS”) OF WELLINGTON’S CODE OF ORDINANCES TO PROHIBIT THE OPERATION OF MACHINERY AND LAWN EQUIPMENT DURING CERTAIN TIMES; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
REQUEST: To amend Chapter 13 - Offenses and Miscellaneous Provisions, Article II - Noise Standards, of the Code of Ordinances to clarify several noise standards for the section labeled “Specific Prohibitions”.

EXPLANATION: The purpose of this amendment is to provide specific prohibitions on the operation of machinery and lawn equipment. This request is in response to an issue that was reported about construction work on the weekends and the noise level, creating an unenjoyable environment for nearby residents. Council requested that Planning and Zoning check the times and adjust according to the desired limitation expressed at a recent Council meeting. This request addresses the concerns and codifies the revised periods for the operation of machinery and lawn equipment.
On April 8, 2025, this item was presented for first reading, and the Council voted unanimously to approve it for second reading.
