AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING CHAPTER 1 (“GENERAL PROVISIONS”), SECTION 1-2 (“DEFINITIONS”) OF WELLINGTON’S CODE OF ORDINANCES TO ADD A DEFINITION FOR NORMAL HOURS OF OPERATION; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
REQUEST: To amend Chapter 1 - General Provisions, Section 1-2 (Definitions), of the Code of Ordinances to add a definition for normal hours of operation.

EXPLANATION: The purpose of this amendment is to add a definition for normal hours of operation for commercial establishments within 300 feet of residential homes within a residential planned unit of development (PUD). The Land Development Regulations require a commercial establishment within 300 feet of residential homes to obtain an extended hours of operation permit to operate outside those hours and refer back to the Code of Ordinances. When the Code of Ordinances was updated in 2022, the definition of normal hours of operation was not included. Recent events highlighted the missing definition.
