ITEM: RESOLUTION NO. R2016-78 (NPDES INTERLOCAL AGREEMENT WITH NORTHERN PALM BEACH COUNTY IMPROVEMENT DISTRICT)
A RESOLUTION OF WELLINGTON, FLORIDA'S COUNCIL APPROVING AND AUTHORIZING THE MAYOR AND CLERK TO EXECUTE THE NPDES FOURTH CYCLE PERMIT INTERLOCAL AGREEMENT WITH NORTHERN PALM BEACH COUNTY IMPROVEMENT DISTRICT, THE LEAD PERMITTEE; AND PROVIDING AN EFFECTIVE DATE.
REQUEST: Approval of Resolution No. R2016-78 authorizing the Mayor and Clerk to execute the NPDES Fourth Cycle Permit Interlocal Agreement with Northern Palm Beach County Improvement District.

EXPLANATION: On December 16, 1996, the United States Environmental Protection Agency issued National Pollutant Discharge Elimination System (NPDES) Permit No. FLS000018 to approximately forty (40) governmental entities designated as the Palm Beach County-Municipal Separate Storm Sewer System ("MS4") Permittees. The Northern Palm Beach County Improvement District has been designated as the Lead Permittee with a seven (7)-member Steering Committee established to coordinate the joint activities conducted under the MS4 NPDES Permit. The term of the permit is one year (1), with renewal on the fiscal year beginning October 1. The MS4 NPDES Third Term Permit expired on March 1, 2016; and the Permittees timely submitted a re-application for a permit renewal, thereby administratively continuing the MS4 NPDES Third Term Permit until such time as a new NPDES permit was issued.
On September 8, 2016, the Florida Department of Environmental Protection issued the MS4 NPDES Fourth Cycle Permit. On September 21, 2016, the NPDES Steering Committee recommended changes to the NPDES Steering Committee Administrative Procedures (Sect. 4 and 5) and approved incorporation of these Revised Procedures into each NPDES Interlocal and Jount Participation Agreement entered into with each Co-Permittee. Due to these changes, a new Fourth Cycle Permit Interlocal Agreement was required (attached).
