ITEM: ORDINANCE NO. 2026-15 (INTERLOCAL SERVICE BOUNDARY AGREEMENT)
AN ORDINANCE OF WELLINGTON, FLORIDA'S COUNCIL, ADOPTING AN INTERLOCAL SERVICE BOUNDARY AGREEMENT (ISBA) WITH PALM BEACH COUNTY TO COORDINATE FUTURE LAND USE, PUBLIC FACILITIES, AND SERVICES IN ADVANCE OF FUTURE ANNEXATIONS WITHIN THE AREA DEFINED BY THE ISBA; AUTHORIZING THE MAYOR TO EXECUTE THE AGREEMENT; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
REQUEST: Approval of Ordinance No. 2026-15 adopting an Interlocal Service Boundary Agreement (ISBA) with Palm Beach County for the area north of Southern Boulevard, approximately 1/2-mile west of Lion Country Safari Road, as illustrated in the Ordinance.

EXPLANATION: On March 10, 2026, the Village Council adopted Ordinance No. 2026-03 annexing the Artistry Lakes property located east of the Arden development. On March 26, 2026, Palm Beach County adopted a resolution objecting to the annexation and initiating a Chapter 164, Florida Statutes, Conflict Resolution process. In response to the initiation of the Conflict Resolution, an Interlocal Service Boundary Agreement (ISBA) between Wellington and Palm Beach County was proposed. The ISBA is designed to address the County's objections to the annexation and to coordinate future land use, public facilities, and services in advance of future annexations within the area defined by the ISBA.
The ISBA does not annex any property. All future annexations will still be required to comply with Chapter 171, Florida Statutes.
After the first reading, the ISBA will be forwarded to the Palm Beach County Board of County Commissioners (BCC) for a first reading and then adopted by Wellington before being adopted by the BCC.
