EXPLANATION:                     It recently came to staff’s attention that an 80’ drainage area reflected on the Palm Beach Little Ranches East Plat as an “easement” was actually conveyed to Acme in fee simple by way of a recorded corrective declaration.  Although the property appraiser shows the area as included within the lot lines of the adjacent lots, Acme maintained the area for many years until recently when some property owners placed obstructions in the drainage area. 

 

At Council’s request, the Village Attorney sent a letter to the property owners on August 22, 2024 with a proposed quit claim deed and hold harmless.  A second letter was sent on September 25, 2024.  To date, only 4 property owners have indicated their willingness to accept the quit claim deed and two property owners, Harry and Theresa Knopp (owners of Lots 8 and 9) and IDA Farm, LLC (owner of Lots 10-12), have requested whether Acme would also convey the 20’ drainage areas between lots 11 and 12 and 8 and 9.  At its meeting on October 8, 2024, Council rejected this request.  Council has also directed that we hold a meeting with the property owners to facilitate a resolution of this issue.   

 

Staff is seeking to facilitate a discussion between the Village Council and the property owners in an effort to move this matter toward resolution.
