REQUEST:   Council review of a fine reduction request for 1672 Farmington Circle

EXPLANATION:  Homeowners Joseph and Jodi Devivo previously contacted code compliance staff concerning a fine reduction.  The homeowners sought a reduction of liens associated with a compliance action in 2014.  The case involves unresolved property maintenance issues accruing a $50.00 per day fine totaling $44,171.20 to date.   The homeowners are involved in a foreclosure action due to financial and medical difficulties and a short sale is under contract.  The buyer has agreed to enter into a Stipulated Reduction Agreement with Wellington to correct the violations and face a potential daily fine if the remaining issues are not corrected within 120 days of the property closing.   The buyer submitted a counter settlement offer in the amount of $1,000.00.   As outlined in the fine reduction policy, Village Staff is authorized to reduce a lien to a maximum of 80% of the original amount.
