A RESOLUTION OF WELLINGTON, FLORIDA'S COUNCIL ACCEPTING AND APPROVING AN EASEMENT ALONG PIERSON ROAD IMMEDIATELY ADJACENT TO THE PALM BEACH EQUINE CENTER LOCATED IN THE NORTHEAST CORNER OF THE SOUTHFIELDS PLAT - PHASE 1 OF PALM BEACH POLO AND COUNTRY CLUB - WELLINGTON COUNTRY - PUD; AND PROVIDING AN EFFECTIVE DATE.

REQUEST: Approval of Resolution No. R2014-51 accepting and approving the Pierson Road Easement.

EXPLANATION: Pierson Road is a public roadway, owned and maintained by the Village of Wellington, that extends from Ousley Farms Road, on the west end, to Fairlane Farms Road, on the east end. There is an approximate 1,518 foot segment of Pierson Road between the C-4 Canal and South Shore Boulevard that is within the Southfields Road right-of-way - a platted, 60 ft. wide, private road right-of-way dedicated and owned by the Southfields of Palm Beach Polo and Country Club Homeowner's Association. A location map is provided herein as Attachment 1.

The proposed easement in favor of Wellington (60' wide and approximately 1,518 feet long), attached herein, corrects this issue and provides the legal mechanism to codify the historical public use of this segment of Pierson Road. Specifically, it provides for public ingress/egress, installing and maintaining public roadway facilities, public water and sewer facilities, bridle trail path and other public uses consistent with and for public use.
All other portions of Pierson Road are located on property under the control of the Village of Wellington.
