ITEM: AUTHORIZATION TO EXECUTE GROUND LEASE AGREEMENT WITH WELLINGTON NATIONAL HOLDINGS, LLC, FOR INSTALLATION OF A WIRELESS COMMUNICATION FACILITY

EXPLANATION: In 2022, the Wellington Council prioritized improving wireless communication, aka cell service, throughout the Village. In the spring of 2023, the Wellington Council approved a master marketing agreement with Arcadia Infrastructure I, LLC (Arcadia) to market Wellington properties for the installation of wireless communication facilities to improve cell service in the Village. Arcadia identified eight locations on Wellington properties for future wireless communication facilities. Option and lease agreements have been executed with Arcadia for five of the eight locations. Arcadia has been working to secure federal approvals and leases with carriers for these locations. One of the eight locations was within the Flying Cow Road right-of-way near Southern Boulevard (SR 80). However, this location was not suitable due to its width. An alternative location for the wireless communication facilities near the golf course maintenance facility east of Flying Cow Road was discussed with the Wellington National Golf Course owners. The proposed ground lease agreement with Wellington National Holdings, LLC, allows Wellington to execute a sublease for the site to Arcadia to install a wireless communication facility. This location will provide needed cell service improvement for the Binks neighborhoods and Binks Forest Elementary. In 2024, the Wellington Council approved an amendment to the Land Development Regulations to add properties leased or dedicated by easement to Wellington to the preliminary approved sites.
