ITEM:   DOG PARK AND 130 VIOLATIONS LIEN RELEASES (THIS ITEM ADDED TO THE AGENDA) 

 

REQUEST:   Ratification of Mr. Stillings’ execution of lien releases for the Dog Park and 130 Violations liens.

EXPLANATION: As part of the foreclosure of the dog park and 130 Violations liens brought against Palm Beach Polo, Inc., Polo requested to transfer the liens to a cash bond.  The court entered orders approving the transfers, setting the amount of the bonds, and requiring that Wellington record lien releases. 

 

Following confirmation that the court-ordered funds were been deposited with the escrow agent, and pursuant to the court’s orders, Wellington prepared and recorded the lien releases.  The releases were executed by Tim Stillings on behalf of Wellington. 

 

Polo, through its counsel, has requested that the Council approve the execution of those documents by Mr. Stillings.  While we believe the execution of the lien releases was a ministerial act given the court orders, we nevertheless are requesting Council to ratify Mr. Stillings’ execution of the releases.
