AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING CHAPTER 1 (“GENERAL PROVISIONS”), SECTION 1-2 (“DEFINITIONS”) OF WELLINGTON’S CODE OF ORDINANCES TO ADD A DEFINITION FOR NORMAL HOURS OF OPERATION; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
REQUEST: To amend Chapter 1-General Provisions, Section 1-2 (Definitions), of the Code of Ordinances to define normal hours of operation.

EXPLANATION: This amendment does not modify the existing context of Chapter 1 of the Code of Ordinances. The purpose of this amendment is to define the normal hours of operation for commercial establishments within 300 feet of residential homes within a residential PUD. The Land Development Regulations refer back to the Code of Ordinances. When the Code of Ordinances was updated in 2022, the definition was not included. The normal hours of operation have always been implemented in accordance with the proposed definition, this request codifies the definition so the LDR reference is consistent with the Code of Ordinances.
