ITEM: ORDINANCE NO. 2024-15 (NOISE STANDARDS)
AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL, AMENDING THE WELLINGTON CODE OF ORDINANCES CHAPTER 13, ARTICLE II (NOISE STANDARDS), SECTIONS 13-4 TO 13-8, TO PROVIDE DEFINITIONS AND CLARIFY PERMISSIBLE SOUND LEVELS AS MORE SPECIFICALLY CONTAINED HEREIN; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
REQUEST: To amend Chapter 13, Article II. - Noise Standards, Section 13-4 to 13-8 of the Wellington Code of Ordinances, to add definitions, and regulations for unreasonably loud noise for certain types of property.

EXPLANATION: Wellington’s noise standards currently require a specific decibel measurement from a calibrated device. This method is appropriate for noise generated from certain devices but does not adequately address the disruption to the peaceful enjoyment of property from other unreasonably loud noises. The proposed code amendments establish standards to address all types of noise and provide a tool for certain activities that are disturbing residents’ peaceful enjoyment of property.
The Wellington Council unanimously approved the proposed Ordinance at first reading on October 8, 2024.
