A RESOLUTION OF WELLINGTON, FLORIDA'S COUNCIL ABANDONING A PORTION OF THE LIMITED ACCESS EASEMENT ALONG BINKS FOREST DRIVE FOR THE BINKS COMMERCIAL CENTRE; AND PROVIDING AN EFFECTIVE DATE.  
 
REQUEST:  Approval of the abandonment of a portion of the Limited Access Easement along Binks Forest Drive for the Binks Commercial Centre.

EXPLANATION:  On May 12, 2015, Council approved a second access drive for the Binks Commercial Centre (R2015-16) as part of the Development Order Approval for the Home Away from Home Daycare Facility located within the Binks Commercial Centre.  Whereas, this second access point is shown on the recorded plat, it is encumbered by a limited access easement dedicated to the Village of Wellington.  It is necessary to abandon the portion of the limited access easement at the location of the proposed access drive location.  This resolution formally abandons a portion of the limited access easement and allows for the second access drive to connect to Binks Forest Drive.
