EXPLANATION:  A proposed zoning text amendment, initiated by staff, in response to an interpretation and pending appeal, to amend the Land Development Regulations related to building height limitations for a portion of a principal structure within residential districts. This amendment would permit a portion of a principal structure to be excluded from the maximum height requirement and to be excluded from the overall calculation of the maximum height of said structure. The amendment to proposed to accommodate those properties that may want to include a tower, ornamental or focal point feature to a principal structure whereas the current regulations do not provide for such opportunity. 

 

SUMMARY:                     Staff is seeking approval of a Zoning Text Amendment to Section 6.5.8.B and 6.10.6-Table B of the Land Development Regulations, related to building height limitations.
