ITEM: DISCUSSION OF PROPOSED ORDINANCE REGULATING THE ESTABLISHMENT AND OPERATION OF MEDICAL MARIJUANA DISPENSARIES IN WELLINGTON
REQUEST: Council discussion concerning whether to move forward with the adoption of an Ordinance that would regulate the location of Medical Marijuana Dispensing facilities and supplemental regulations concerning their operation. Staff seeks direction on processing and content of the Ordinance.

EXPLANATION: On November 8, 2016 Florida voters passed Amendment 2, which expands the original 2014 list of eligible patients to acquire and use Medical Marijuana, and contemplates the establishment of retail dispensary facilities throughout the State. Currently there are no provisions in the Wellington LDR to regulate such facilities. Although the State has not yet formulated their rules for the establishment of retail facilities, many jurisdictions have either adopted regulations or have passed moratoriums prohibiting facilities to be opened until regulating ordinances can be adopted. This Workshop discussion is to review a possible regulating ordinance and obtain Council direction on how to proceed. The ordinance would require review by the Planning, Zoning and Adjustment Board and two advertised public hearings before Council.
