REQUEST:   Complaint filed by homeowner Mr. Patrick O’Hara to the Construction Board of Adjustments and Appeals against One Hour Air Conditioning & Heating for a willful Code violation.

EXPLANATION: Mr. Patrick O’Hara filed a complaint against One Hour Air Conditioning & Heating because the contractor failed to obtain a required building permit for work on air-condition duct at his residence in violation Section 105 of Florida Building Code. Further the work completed by above contractor was found in violation of various codes as identified in attached Wellington Inspection report.   

 

 

 Section 105 Permits

105.1 Required. Any Contractor, owner, or agent authorized in accordance with Florida Statute 489 who intends to construct, enlarge, alter, repair, move, demolish, or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove, convert or replace any impact-resistant coverings, electrical, gas, mechanical, fire protection or plumbing system, or accessible or flood resistant site element, the installation of which is regulated by this code, or to cause any such work to be done, shall first make application to the building official and obtain the required permit. 

 

Furthermore, the work completed by the above contractor was found in violation of various codes as identified in attached Wellington Inspection report.
