ITEM: RESOLUTION NO. R2019-03 (LASSERGUT FARMS USA, INC. EASEMENT ARGEEMENT)
A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING AND AUTHORIZING THE MAYOR TO EXECUTE THE EASEMENT AGREEMENT BETWEEN WELLINGTON AND LASSERGUT FARMS USA, INC., TO PROVIDE A UTILITY EASEMENT AND A PUBLIC EQUESTRIAN BRIDLE TRAIL EASEMENT; AND PROVIDING AN EFFECTIVE DATE.
REQUEST: Authorization to execute the easement agreement between Wellington and Lassergut Farms USA, Inc., for a utility easement and a public bridle trail easement.

EXPLANATION: A bridle trail currently exists on the south side of Pierson Road near the intersection with South Shore Boulevard. Although the public uses and has access to this trail, part of the trail lies within Lassergut Farms USA, Inc.’s property at 13250 Pierson Road. The attached easement agreement would provide a utility easement and a public bridle trail easement where the path currently exists. These easements would grant Wellington the authority to operate and maintain utilities, and create and maintain a public bridle trail within the easement area. Resolution No. R2019-03 authorizes the Mayor to execute the agreement (attached).
