EXPLANATION:                     Staff is seeking authorization to:

 

(1)                     Award a construction contract Foster Marine Contractors, Inc., for the rehabilitation of lift stations 5, 39, 41, 44, 74 & 85 in the amount of $2,373,623.00. This project includes the comprehensive rehabilitation of six existing lift stations generally including pumps, wet wells, vaults, piping, electrical, control panels, fencing, landscaping and site civil improvements. The stations are approximately thirty (30) years old and require extensive rehabilitation.

 

On November 7, 2018, Wellington released ITB 002-19/DZ on Demandstar, seeking qualified firms to provide such services. The solicitation was also advertised in the Palm Beach Post and posted on Wellington’s website. On December 14, 2018, five (5) proposals were received as summarized below:

The lowest responsive, responsible bidder was B & B Underground Construction, Inc., a Palm Beach County local vendor, who submitted a bid price of $2,708,623.98. The next lowest responsive bidder was Foster Marine Contractors, Inc., a Western Communities local vendor who provided a bid price of $2,752,850.00.

 

Pursuant to Chapter 9 of the Village’s Purchasing Manual, if a Western Communities local business submits a price bid within 5% of a non-local or Palm Beach County local business submitting the lowest bid, the lowest Western Communities local business shall have the opportunity to submit a best and final bid equal to or lower than the low bid.

 

Foster Marine Contractors, Inc. qualified as a local Western Communities vendor and was within 5% of the low bid. Pursuant to the Village’s Local Preference Policy, they were afforded the opportunity to submit a best and final bid equal to or lower than the price submitted by B & B Underground Construction, Inc.  Foster Marine Contractors, Inc. elected to submit a revised bid of $2,708,623.00, less than the price submitted by B & B Underground Construction, Inc. ($2,708,623.98). 

 

The revised bid ($2,708,623.00) includes allowances totaling $335,000. Staff recommends awarding the contract to Foster Marine Contractors, Inc., in the amount of $2,708,623.00 (bid amount) minus the allowance amount of $335,000 for a total cost of $2,373,623.00.

 

(2)                     Award a task order to Mock Roos & Associates, Inc., utilizing previously Council approved engineering services contract (RFQ#011-15/ED), to provide construction phase engineering services for the lift station rehabilitation project in the amount of $74,200.00

 

The total cost of construction (Foster Marine) and construction phase engineering (Mock Roos) is $2,447,823. The current amount budgeted for this project is $1,900,000.  A budget amendment in the amount of $550,000 (attached) is required to complete the project.

 

The budget shortfall can be attributed to contingencies and increased labor costs, increased material costs due to tariffs, uncertainty of future tariff costs and their impact on costs of material, and current market demands.

 

(3)                     Approval of Resolution No. R2019-09 amending the Utility Fund or Fiscal Year 2018-2019 by allocating fund balance for the Lift Station Upgrades Capital Project; and providing an effective date.

 

Staff recommends 1) Awarding a contract to Foster Marine Contractors, Inc., for the rehabilitation of lift stations 5, 39, 41, 44, 74 & 85 in the amount of $2,373,623.00; 2) Awarding a task order to Mock Roos & Associates, Inc., to provide construction phase engineering services for the lift station rehabilitation project in the amount of $74,200; and 3) Approval of Resolution No. R2019-09 amending the Utility Fund or Fiscal Year 2018-2019 by allocating fund balance for the Lift Station Upgrades Capital Project; and providing an effective date.
