ITEM: RESOLUTION NO. R2019-34 (AMENDED AND RESTATED INTERLOCAL AGREEMENT BETWEEN WELLINGTON AND PALM BEACH COUNTY FOR EMERGENCY OPERATIONS INTEROPERABILITY)
A RESOLUTION OF WELLINGTON, FLORIDA'S COUNCIL AUTHORIZING THE MAYOR AND CLERK TO EXECUTE THE AMENDED AND RESTATED INTERLOCAL AGREEMENT BETWEEN WELLINGTON AND PALM BEACH COUNTY FOR EMERGENCY OPERATIONS INTEROPERABILITY THROUGH COUNTYWIDE COMMUNICATION AMONG PUBLIC SAFETY AND GENERAL GOVERNMENTAL AGENCIES; AND PROVIDING AN EFFECTIVE DATE.
REQUEST: Approval of Resolution No. R2019-34 authorizing the Mayor and Clerk to execute the Amended and Restated Interlocal Agreement between Wellington and Palm Beach County for emergency operations interoperability.

EXPLANATION: On July 23, 2002, Council accepted and approved an Interlocal Agreement with the Board of County Commissioners of Palm Beach County that provided Wellington with access to common talk groups established on Palm Beach County’s Radio System.
On June 14, 2019, Wellington received an Amended and Restated Agreement from Palm Beach County. As the original Agreement has been amended several times since its inception in 2002, the County has taken the opportunity to amend and restate the Agreement for ease of reference. The only sections which have been changed from the existing Agreement are: 1) Section 5.05 Federal Shared Encryption Key which sets forth the Village’s responsibilities to keep the encryption key confidential; and 2) Section 8A regarding insurance which has been added in its entirety.
The initial term of the Amended and Restated Agreement is for five (5) years and shall commence immediately upon full execution of the Agreement. The Agreement also provides for two (2) additional five (5) year terms with notification to the County six (6) months prior to expiration of the Village’s intent to renew.
The attached Amended and Restated Agreement, when effective, terminates and replaces Interlocal Agreement No. R2002-1353 and all subsequent amendments approved through Wellington Resolution Nos R2006-135, R2012-27 and R2017-35.
