EXPLANATION: Jason and Shelby Colman, owners, are requesting to vacate/abandon a 12.5-foot wide portion of a 25-foot wide lake maintenance easement located at 14603 Horseshoe Trace. An existing pool encroaches within this lake maintenance easement. The encrochment was authorized via a permit issued by Acme Improvement District on April 4, 1988. The owner wishes to abandon the portion of the easement to have a clear title on the property.
The Engineering Services, Utility, and Planning Departments have determined the requested vacation of the 12.5-foot wide portion of a 25-foot wide lake maintenance easement is consistent with the public interest and will not adversely affect utility or maintenance access to other properties or the lake.
