REQUEST: Council Discussion of the Golf Cart Ordinance.

EXPLANATION: Council received a draft of the Golf Cart Operational Study on June 30, 2020. The study address golf cart operations on roadways and pathways that are under Wellington's jurisdiction, in accordance with state statutes; specifically, section 316.212. The study considered the "speed, volume, and character of motor vehicle traffic using the road or street" prior to making a recommendation to allow golf cart usage on designated Village streets and pathways.

The majority of the neighborhood roads within Wellington's jurisdiction have speed limits of 25 mph and low traffic volumes. However, to travel from the neighborhoods to destinations, such as schools and shopping centers, the multi-purpose pathways adjacent to the Village's collector roads need to be utilized. The state statutes permit the Village to impose additional restrictions for golf cart operation on Village pathways.

With that in mind, and utilizing the Operational Study, a draft ordinance has been prepared for Council discussion. We would like to start the committee hearing and public input process. We believe this should go to the Public Safety, Education, Parks & Recreation, Equestrian and Planning Zoning & Adjustment committees. It will take about four months to go through that process.

The items we would like to discuss are:

* Pathway Width - State minimum is 8-feet
* Age - Minimum age of driver using pathway. Streets/roads - age 14 per the state. Draft ordinance proposes 16 and valid driver's license for pathways.
* Registration - one-time or annual renewal? Village to issue a decal?
* Safety Equipment
* Traffic Regulations - stop condition at all intersections before proceeding
* Yield to Other Traffic
* Occupancy - limited to available seating within the cart
* Enforcement - PBSO
* Timing/Effective Date - of the ordinance
