ITEM: RESOLUTION NO. R2021-01 (ACCEPTANCE OF INTERLOCAL AGREEMENT WITH SOLID WASTE AUTHORITY)
A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING AND AUTHORIZING THE MAYOR AND CLERK TO EXECUTE AN INTERLOCAL AGREEMENT FOR THE DELIVERY OF MUNICIPAL SOLID WASTE, TO DESIGNATE FACILITIES AND FOR A MUNICIPAL REVENUE SHARING RECYCLING PROGRAM; AND PROVIDING AN EFFECTIVE DATE.

EXPLANATION: The attached Agreement updates the current Interlocal Agreement with the Solid Waste Authority. The main purpose of the new Agreement is to incorporate the required language pertaining to new subsection 22 of Florida Statute 403.706. The existing agreement includes both the delivery of municipal solid waste to a designated facility as well as providing for the Village’s participation in a coordinated County-wide recycling program.
This agreement includes a municipal revenue sharing recycling program which provides for a minimum of 50% of the Net Revenues (recovered residential materials revenue less processing cost) earned from the sale of residential recovered materials to be paid to the Village on a quarterly basis.
The agreement term would begin on effective date of the Agreement and provides for automatic annual renewals until and unless one or the other party exercises their right to terminate as stated in the Agreement. The agreement provides for proper control of solid waste processing and disposal in cooperation with Federal, State and Local agencies.
