ITEM: ORDINANCE NO. 2020-12 (REPEAL AND REPLACE THE CAPITAL IMPROVEMENTS ELEMENT)
AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING THE WELLINGTON COMPREHENSIVE PLAN, MORE SPECIFICALLY, TO REPEAL AND REPLACE THE CAPITAL IMPROVEMENTS ELEMENT IN ITS ENTIRETY, AS CONTAINED HEREIN; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE.

EXPLANATION: The Wellington Comprehensive Plan is being updated. The Plan forms the blueprint for Wellington’s future for the next 10 to 20 years. The Plan is comprised of 10 “elements” or chapters and each element consists of goals, objectives, and policies to guide development and redevelopment, transportation, infrastructure, parks, and capital improvements.
The Capital Improvements Plan identifies and funds public facilities and services needed in the upcoming fiscal year and within the next five years to address level of service impacts. Together, the Village’s Capital Improvements Plan and Capital Budget provide the planning and funding for all capital improvements in Wellington. The Comprehensive Plan, the Capital Improvements Element, and the Capital Improvements Plan address the services and facilities that the Village provides directly, particularly those which are required to be provided concurrently with the impacts of development.
The update to the Capital Improvements Element revised and reorganized the goals, objectives, or policies. After each goal, objective, and policy, there is a reference (italicized red text) identifying whether the current goal, objective, or policy which was revised including the following:
• The annual update of the Five-Year Capital Improvements Plan (CIP) for Level of Service as required by Section 163.3177 (3)(b) of Florida Statutes.
• Simplifies the language for level of service standard for services provided by the Village.
• Removes level of service standards for services that are outsourced.
• Removes the 10-Year School District of Palm Beach County Capital Improvements Schedule, but adopts it by reference.
At the November 17, 2020 Planning, Zoning, and Adjustment Board meeting, the Board voted unanimously (5-0) to recommend approval of Ordinance No. 2020-12.
At the December 8, 2020 Village Council Meeting, the Council voted unanimously (5-0) approval of the first reading of Ordinance No. 2012-12 and to transmit the proposed ordinance to the Department of Economic Opportunity (DEO) and all review agencies for comments. Minor changes were recommended by the review agencies and are highlighted in Exhibit B of the Staff Report.
