A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL ABANDONING A 6 FOOT BY 41.16 FOOT PORTION OF A 12 FOOT WIDE UTILITY EASEMENT, TOTALING APPROXIMATELY 247.1 SQUARE FEET, LOCATED WITHIN LOT 18, BLOCK 25, SUGAR POND MANOR OF WELLINGTON (13922 COLUMBINE AVENUE), MORE SPECIFICALLY DESCRIBED HEREIN; PROVIDING AN EFFECTIVE DATE.
REQUEST:
1. Approval of Resolution No. AC2021-07 to vacate a 15 foot portion of a 25 foot wide Maintenance Easement, totaling approximately 1,134 square feet, located at 13922 Columbine Avenue.
2. Approval of Resolution No. R2021-15 to vacate a six (6) foot by 41.16 foot portion of a 12 foot wide Utility Easement, totaling approximately 247.1 square feet, located at 13922 Columbine Avenue.

EXPLANATION: David and Natalie Vitola, owners, are requesting to abandon a 15 foot portion of a 25 foot wide Maintenance Easement and a 6 foot by 41.16 portion of a 12 foot wide Utility Easement located at 13922 Columbine Avenue. The purpose for the abandonment is to construct a pool, patio/screened in porch, and pool equipment within the areas proposed to be abandoned.
The Maintenance Easement was dedicated to the Acme Improvement District for lake/canal maintenance purposes and shall be abandoned by the Acme Board of Supervisors. The Utility Easement did not have a specific dedication on the plat, but typically they are dedicated for utility purposes (water, sewer, cable, etc.) and shall be abandoned by the Village Council.
The Engineering Services, Utility, and Planning Departments have determined the requested abandonment is consistent with the public interest and will not adversely affect utility or maintenance access to other properties
