A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING THE PUBLIC ASSEMBLIES ADMINISTRATIVE POLICY TO PROVIDE FOR WAIVER OF CERTAIN REQUIREMENTS, FEES, INSURANCE, APPLICATION REVIEW, AND FAST-BREAKING ASSEMBLY LOCATIONS; ADOPTING A FEE FOR PUBLIC ASSEMBLY APPLICATIONS; AND PROVIDING AN EFFECTIVE DATE.

EXPLANATION:                     In adopting its revised Code of Ordinances, Wellington repealed Chapter 54 titled “Streets, Sidewalks, and Other Public Places” and amended and renumbered it as Chapter 20.  The new Chapter 20 created Article IV, “Public Assemblies” which is intended to facilitate the exercise of the constitutional rights of free speech and peaceful assembly on certain Wellington property, while fostering Wellington’s substantial and compelling interests of protecting the public health and safety (the “Public Assembly Regulations”). 

 

The Public Assemblies Policy provides for the administration of the Public Assembly Regulations by (1) outlining application requirements, (2) providing for permit application fees, security deposits, costs, and conditions for waiver of same, (3) creating an application review process, (4) establishing insurance requirements, and (5) providing locations for fast-breaking assemblies.

 

The Public Assemblies Policy provides for a non-refundable application fee to defray the administrative costs of reviewing and processing applications for public assembly permits to be established by resolution of the Wellington Council.  Staff is recommending a fee of $50 which, if adopted, will be added to the Development Application Fee Schedule, Appendix A of the Development Review Manual.
