REQUEST:                     Approval of Resolution No. AC2023-01 accepting and approving the Easement Agreement.

EXPLANATION:                     This is an Easement Agreement between ACME Improvement District (“Grantor”) and Far Niente Stables I, LLC and Wellington Cypress Golf, LLC (collectively, “Grantee”) to grant an easement on, and over, that certain portion of the Canal C-6, as legally described in Exhibit B of the Easement Agreement  (the “Canal Access Easement”) for the purpose of permitting Grantee to install, construct and maintain a multi-modal pathway  and permitting the Grantee and all subsequent owners of the Grantee Lands (Exhibits A-1 and Exhibit A-2 described in the Easement Agreement) and their employees, agents, contractors, subcontractors, licensees, permittees, guests and all other invitees of Grantee to use the Canal Access Easement for the Grantee Lands, which may now or hereafter be developed on the Grantee Lands.
