AN ORDINANCE OF WELLINGTON, FLORIDA'S COUNCIL, AMENDING WELLINGTON'S LAND DEVELOPMENT REGULATIONS, MORE SPECIFICALLY, A ZONING TEXT AMENDMENT (PETITION 2023-0002-ZTA) TO MODIFY THE STANDARDS FOR MULTIPLE USE PLANNED DEVELOPMENT (MUPD) ZONING DISTRICT IN ARTICLE 6, SECTION 6.5.6, TO INCLUDE CONSERVATION AS A PERMITTED USE TYPE, AND TO AMEND THE MAXIMUM PERCENTAGE ALLOWED FOR A SINGLE USE WITHIN A MUPD, AS MORE SPECIFICALLY CONTAINED HEREIN; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
REQUEST: Approval of Ordinance No. 2023-14 amending Wellington's Land Development Regulations (LDR) by modifying regulations related to Multiple Use Planned Development (MUPD) Zoning Districts to include conservation as a permitted use and to amend the maximum percentage allowed for a single use.

EXPLANATION: The applicant is requesting to amend Wellington's LDR to include conservation as one of the permitted uses and remove the incremental approach to the maximum percentage of a single use as it relates to the project's acreage. The applicant is currently proposing a mixed-use project (Lotis 2) that has one (1) of the proposed use types (residential) exceeding the maximum percentage allowed (30% for projects more than 30 acres). The incremental approach to the maximum percentage of a single use was intended to ensure that no single use would have a significant land area allocation and will have multiple uses for the mixed-use project.
Approval of this Zoning Text Amendment (ZTA) would allow land allocation not to exceed 60% for a single use based on factors Council will consider when approving a project master plan, as listed in the proposed language (Ordinance No. 2023-14 Exhibit A).
On September 28, 2023, Wellington's Planning, Zoning and Adjustment Board (PZAB) recommended approval of the text amendment with a 6-0 vote.
