ITEM:                     FIRST READING OF ORDINANCES AMENDING CHAPTERS 17 THROUGH 24 OF WELLINGTON’S CODE OF ORDINANCES 

 

REQUEST:                     Approval on First Reading of Chapters 17 through 24 of Wellington’s Code of Ordinances.

EXPLANATION:                     Wellington is continuing its efforts to simplify and update its Code of Ordinances so that it reflects the changes in circumstances, goals, and desires that have occurred since original adoption.  The proposed revisions make the Code easier to read and understand, eliminate duplicative and conflicting provisions, and update references to other laws.  Chapters 1 through 8 were presented to and approved by Council on November 9, 2021 on first reading.  Chapters 9 through 16 were presented to and approved by Council on January 25, 2022 on first reading.  

 

Once updated, the new Code will reorder the chapters to make it entirely alphabetical (as originally intended) and it will have 24 chapters.  The proposed changes will not materially change the way Wellington operates and no major changes to the regulations have been made, except that a new article titled “Public Assemblies” is being proposed as part of the revised Chapter 20, titled “Streets, Sidewalks, and Other Public Places.”  In order to administer these new regulations, a Public Assembly Policy is also being proposed.  The proposed policy is included and will be presented for Council approval upon second reading of the new Code. 

 

A spreadsheet identifying all of the proposed changes to Chapters 17 through 24 is attached.  Once all of the chapters have been adopted on first reading, staff will bring forward the entire rewritten Code for adoption on second reading.
